ENVIRONMENTAL LAW

We have been regularly advising multinational companies on regulatory issues relating to environment in India besides representing our clients in environmental litigation matters before the Hon’ble Supreme Court of India, National Green Tribunal, High Courts and Appellate Authorities.

We have represented leading multinational biotech companies, Association of Indian Seed Companies and agricultural universities before the Hon’ble Supreme Court of India and various High Courts in Writ Petitions (Public Interest Litigations) and before Appellate Authority wherein the introduction of biotechnology in India was challenged under the Environment Protection Act, 1986. The petitions also dealt with the adequacy of the statutory guidelines concerning GM crops in India particularly in consequence of the Cartagena Protocol and implementation of the conditions of commercial approval of genetically engineered crops/ seeds. The proposed legislation would regulate the research, manufacture, importation and use of products of modern biotechnology. We are advising clients on the issues involved with the introduction of GM food (Bt Brinjal, Bt Rice etc) in India and regulatory approvals in respect thereof. We are advising clients on the issues arising under the Biological Diversity Act, 2002 and regulatory compliances thereunder.

We are regularly advising clients on the regulatory compliances under the provisions of the Water (Prevention and Control of Pollution) Act, 1974; Air (Prevention and Control of Pollution) Act, 1981; Environment (Protection) Act, 1986 and the rules framed there-under. We are also advising clients including real estate companies on issues relating to groundwater usage and waste management. We have advised clients on environmental issues in real-estate, infrastructure and energy sectors besides advising on emission reduction.
