The Firm is extensively involved in advising and drafting of employment agreements, employee handbook, consultancy agreements, service bonds, deputation agreements, grievance settlement procedures, policies to prevent sexual harassment, leave policies, rules & regulations, certification of standing orders, and memoranda of settlement with trade unions, amongst others.

The Firm has also successfully conducted numerous human resource audits, which generally focus on issues pertaining to compliance with all necessary employment statutes’ requirements under the Union law; compliance with the rules of employment (if any) under laws made by the State concerned in which the premises/factory of employer is situated[1]; compliances with respect to outsourced staff (e.g. contract labour) and the legal consequences involved; analysis of complaints pertaining to sexual harassment, if any; analysis of the possible liabilities of the company in case of any employee related dispute.

The Firm has further assisted clients on issues such as relating to severance / termination, resignations/abandonment of job, lay offs, closure and transfer of undertakings, domestic enquiries, gratuity, provident fund, employees’ state insurance, amongst others.

Apart from the above, the Firm also advises several clients on their day-to-day legal issues pertaining to operations, compliance, governance, obtaining requisite permissions from the regulatory authorities, statutory filings, maintenance of records and registers, amongst others.

We have been advising a leading asset management group on various employee/ service law compliance issues, and assisting them on day to day operational issues (such as resignation, termination, abandonment, retrenchment, etc.) and in obtaining registration under the Shops and Establishment Act, Contract Labour Act, Inter-State Migrant Workmen Act, Employee State Insurance Act, etc. We have also been involved in advising on and drafting the superannuation fund scheme, provident fund scheme, the employee rules and regulations, code of conduct, policy to prevent sexual harassment, employment agreements, trainee agreements, confidentiality agreements, and opining on issues pertaining to closure, lay off and transfer of employees for the Fidelity Group. We are also involved in conducting regular corporate and labour audits of Fidelity to ensure due compliances by the company.

We have also conducted an extensive HR audit for a healthcare group. We have been involved in the drafting of employment agreements, service bonds, trainee agreements, confidentiality agreements, and opining on issues pertaining to enforceability of service bonds, ESOP, non solicitation and non-compete agreements, non-disclosure agreements, etc. We have advised United Health Group on various employee / service law compliance issues, and assisting them on day to day operational issues (such as resignation, termination, abandonment, retrenchment etc.) and in obtaining registration under the Shops and Establishment Act, Contract Labour Act, Inter- State Migrant Workmen Act, Employee State Insurance Act, etc. We are also advising them on and drafting the employee rules and regulations, code of conduct, policy to prevent sexual harassment.

We have been advising several software majors on several compliance and regulatory issues and implementation of various corporate actions, including issues related to change of management and employee stock options.
